Refer new clients, get an iPad!

Term: The Free iPad Promotion (“Promotion”) begins on October 17, 2011, at 8:00 a.m. Eastern Standard Time (PST), and ends on November 1, 2012 at 5 p.m., EST (“Term”).

Eligibility: The Amazon Gift Card/ iPad 2 Promotion is open to anyone.  Anyone may refer new clients to CMDI.  Referrer may not be an employee of the referred client. Entrants must be legal residents of the 50 United States, District of Columbia and Puerto Rico, who are above the age of majority in the state or territory in which they reside at the time of entry. Void where prohibited. Employees of CMDI and its affiliated companies and members of the immediate families of each are not eligible. Promotion is subject to all local, state and federal laws and regulations. By entering this Promotion, all entrants agree to comply with and be bound by these Official Rules, and to comply with all federal, state and local laws and regulations.

Prizes: (1) $100 Amazon Gift Card for each Eligible Client Referral. (1) iPad (Model: 32 GB Wi-Fi iPad 2 -MSRP: $599) for the referrer’s third Eligible Client Referral.

Rules:  “Eligible Client Referral” is defined as a referral of a new client who signs a minimum 12 month contract with CMDI.  New client must mention the referrer during the sale. Cannot be combined with any other offer.

Prize Restrictions: Limit one (1) iPad per individual/household/company during the Term. Prizes are non-transferable, and no substitutions are allowed except by CMDI, who reserves the right to award a prize of equal or greater value, should the prize become unavailable for any reason. Any and all taxes and costs associated with the receipt and use of the prize are the responsibility of the winner. The offer may be withdrawn at any time without notice but all valid client referrals completed before the end of the promotion will be fulfilled.

Conduct: By participating, entrants agree to comply with and be bound by these Official Rules. Failure to comply with these Official Rules may result in disqualification from the Promotion. Entrants further agree to comply with and be bound by decisions of CMDI, which shall be final and binding in all respects.

Release and Limitation of Liability. By entering, participants release and hold harmless Sponsor, respective parent, subsidiaries, affiliates, directors, officers, employees and related entities from any and all liability, claims or actions of any kind whatsoever for injuries, damages or losses to persons and property that may be sustained in connection with the receipt, ownership, or use of the prize from or arising out of participation in this Promotion.

Disputes: Except where prohibited or otherwise outlined in these Official Rules, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Promotion or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate Court in the Commonwealth of Virginia; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the Commonwealth of Virginia, without giving effect to any choice of law or conflict of law rules (whether of the Commonwealth of Virginia or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the Commonwealth of Virginia.
